Class action risk for the insurance industry

Past event
28 July 2021, 11:00 - 12:00 UTC +00:00

The number of class actions being filed in Europe is showing a relentless upward trend with a 120% growth between 2018 and 2020. Drivers behind this growth include new procedural devices, increasingly aggressive claimant law firms and highly active litigation funders.

Insurance companies are at risk where policies respond to class actions against insureds. Separately, insurers may also be direct defendants in class actions.

To help insurers map and tackle this new and multijurisdictional risk, CMS Dispute Resolution and Insurance experts will provide an insight into:

  • Key areas of risks for insurance companies
  • Developing class action procedures, including (U.S style) opt-out class action procedures, and their differences across key EU jurisdictions
  • Guidance on steps to avoid claims arising
  • Defence against class actions and non-proliferation strategies.

This webinar is based on the CMS European Class Actions Report 2021, a major study of collective proceedings filed in Europe over the past five years, and on the experience of leading insurance experts.

We hope you will find this webinar insightful and that you will be able to join us.
